Amended March 2008.
1) NAME
(a) The name of the Club shall be the "Yass Antique Motor Club Incorporated", hereafter
referred to as "the club".
(b) The club colours shall be maroon and white.
2) OBJECTS
The objects of the club shall be:
(a) The restoration and preservation of vehicles thirty (30) years old and older.
(b) The encouragement of interest in such vehicles.
(c) To promote and organise rallies and exhibitions and such events as deemed suitable for
the use of such vehicles.
3) DEFINITIONS
(a) VETERAN
Any motor vehicle manufactured prior to 31st December, 1918.
(b) VINTAGE
Any motor vehicle manufactured between January 1, 1919 and December 31, 1930.
(c) POST-VINTAGE
Any motor vehicle manufactured between January 1, 1931 and December 31, 1939.
(d) CLASSIC
Any motor vehicle manufactured between January 1, 1940 and December 31, 1949.
(e) HISTORIC 50’s
Any motor vehicle manufactured between January 1, 1950 and December 31, 1959.
(f) HISTORIC 60’s
Any motor vehicle manufactured between January 1, 1960 and December 31, 1969.
(g) MODERN CLASSICS
Any vehicle manufactured between 1st January 1970 and 31st December 1978.
The termination date is to be extended by one year, each and every year, thereafter
in order to maintain the 30 year age criterion in the objects of the club.
4) MEMBERSHIP
There will be one class of membership. Any person who is the owner of an eligible vehicle, or a person who is interested in the objects of the club shall be eligible for membership.
A register of members shall be kept by the club, showing the name, address and date of commencement of membership for each member. Provision for noting the date of cessation of membership shall also be contained in the register.
5) APPLICATION FOR MEMBERSHIP
An applicant for membership shall:
(a) have been nominated by a member of the club and the nomination seconded by another
member.
(b) the election of the applicant is to be conducted at a meeting at which the applicant is not
present, unless a majority of the members present so resolve.
6) MEMBERSHIP FEES
(a) Members shall pay a common fee, which shall be determined by the club at a general
meeting.
(b) Membership fees shall fall due on 1st January each year.
(c) Any member joining after 30th June shall be required to pay only half of the applicable
annual membership fee.
(d) All new members joining the club shall pay a joining fee, as determined by the club at a
general meeting.
7) TERMINATION OF MEMBERSHIP
Membership shall cease on the following conditions:
(a) Resignation.
(b) Failure to pay membership fees within two months of the due date.
(c) Expulsion.
8) DISCIPLINING OF MEMBERS
(a) The club may expel or otherwise punish or penalise any member whose conduct is
discreditable or injurious to the character or interests of the club.
(b) Before any member is expelled or otherwise punished or penalised his/her conduct shall
be inquired into subject to inquiry by the committee and the member shall be given the
opportunity to defend himself/herself and to justify
or explain his/her conduct.
(c) Provided that a quorum is established and the majority of members present are of the
opinion that the member has been guilty of such conduct, he/she may be expelled,
suspended, or otherwise punished or penalised.
(d) Should any Member fail to appear at any enquiry conducted under Clause 8(b) and (c),
the club may proceed, in the member's absence, to conduct the inquiry and make it's
findings.
9) MANAGEMENT
(a) The club shall have its affairs controlled and managed by the office bearers and other
members, collectively known as the Committee.
(b) The office bearers shall be the President,Vice-President,Secretary and Treasurer and
other such other officers as the Club may deem necessary, from time to time, for the
smooth running of the club.
(c) All officers of the club shall serve twelve (12) months, taking office at the Annual General
Meeting,or from the meeting of election to office,in the case of a casual vacancy.
(d) No elected officer shall hold office for more than two consecutive years at any one time,
except under exceptional circumstances.
(e) A member of the committee shall cease to hold office upon resignation in writing, removal
as a member of the club, or absence from three successive meetings without approval
from the committee.
10) MEETINGS
(a) There shall be an ordinary meeting of the club, held monthly.
(b) The meetings shall be held at such place as the Executive Committee shall from time to
time determine and shall commence at 7:30 pm or as soon after as may be convenient.
(c) The quorum for all meetings shall be five (5) financial members.
(d) Matters arising at any meeting shall be decided by the majority of votes of those present.
In the case of an equality of votes the person appointed to chair the meeting shall have a
casting vote.
(e) The Annual General Meeting shall be held each year in March.
(f) The business of the Annual General Meeting shall be:
(i) to receive reports for the preceding year from the President and Treasurer.
(ii) to elect office bearers and committee members for the ensuing year.
(iii) to receive such other reports and conduct such other business as the meeting may
deem necessary.
(g) Financial members present shall be entitled to have and exercise one vote at ordinary
meetings, and Annual General Meetings, and Special General Meetings of the club, if they
are present.
(h) The committee may, whenever it thinks fit, convene a Special General Meeting of the club.
At least twenty one (21) days notice in writing must be given to members of all Special
General Meetings.
(i) Notice of motion to rescind any resolution duly passed at a meeting of the club shall be
given in writing to the Secretary and maybe moved on, at any meeting thereafter.
(j) The majority necessary to carry any such resolution shall be two thirds of those members
present and eligible to vote at such meeting.
(k) This constitution may be amended or have additions made thereto at any Annual General
Meeting or Special General Meeting of the Club, providing twenty one (21) days notice in
writing has been given to members of the club.
(l) The majority necessary to carry such motions, amendments or additions shall be two
thirds of those members present and eligible to vote.
11) MEMBERS LIABILITY
The members of the club shall have no liability to contribute towards the payment of debts and liabilities of the club or the costs, charges and expenses of the winding up of the club, except in respect of any unpaid monies due by them to the club,including unpaid membership fees.
12) OFFICE BEARERS
(a) The President, or in the President's absence, the Vice-President, shall act as chairperson
at each meeting of the club.
(b) If the President and Vice-President are absent from a meeting or unwilling to act, the
members present at the meeting shall elect one of their number of those present to act as
chairperson.
(c) The President shall prepare and submit to the Annual General Meeting a full and
complete report of the clubs membership, activities and progress for the preceding twelve
months.
(d) The Secretary shall keep records of the business of the club including the rules, minutes
of all meetings, and a file of all correspondence, and shall submit all correspondence to
the meeting of the club immediately following receipt thereof.
(e) The Secretary's records shall be available for inspection by any member, providing
reasonable notice is given, and shall be held in the custody of the Secretary.
(f) The Treasurer shall ensure that all monies received by the club are paid into an account
in the club's name. Payments shall be made through a cheque signed by two signatories
authorised by the committee.
(g) The Treasurer shall ensure that correct books and accounts are kept showing the
financial affairs of the club. All payments must be approved for payment by the
committee.
(h) The Treasurer shall give a report of the financial status of the club at each monthly
meeting and table the Audit report at the Annual General Meeting.
(i) The Treasurer's records shall be available for inspection by any Member, providing
reasonable notice is given, and shall be held in the custody of the Treasurer.
13) ADDITIONAL COMMITTEE MEMBERS
(a) A librarian may be elected to take care of any books, magazines, periodicals and
general literature the club may receive.
(b) A Publicity Officer may be elected to publicise and promote the club's activities.
(c) An editor may be elected to organise the publication of a regular newsletter or
magazine.
(d) A property officer may be elected to be responsible for:
(i) caring and maintaining of all club equipment or delegating persons for
maintenance purposes.
(ii) maintaining a list of aforesaid equipment.
(iii) issuing and collecting the aforesaid equipment or delegating responsibility.
(e) A club registration officer may be elected to liaise with the Relevant Authority and be responsible for all the formalities concerning the processing of Historic Concessional
Registration. This officer shall also be responsible for maintaining an up-to-date
register of all club number plates, maintaining the movements book and ensuring all
vehicles on concessional registration have the necessary insurance on their vehicles.
14) COMMITTEES
There shall be the following committees:
(a) The Executive Committee: This committee shall consist of the President, the Vice-
President, the Secretary and the Treasurer, and any other members elected to it as seen fit from time to time.
(b) The Events Committee: This body shall consist of at least two (2) members and shall organise, plan and control such events as the club may from time to time desire or direct.
(c) The Registration Committee: This body shall consist of at least two members and shall be
responsible for:
(i) investigating and dating vehicles for concessional registration.
(ii) inspection for road worthiness of cars requiring concessional registration. Preference of
election of the registration committee will be given to members qualified to become
authorised examiners. The registration committee is responsible for making itself familiar
with the requirements of the Roads and Traffic Authority for Historic Vehicle Concessional
Registration Scheme.
15) PUBLIC OFFICER
(a) The committee shall ensure that a person, over the age of 18 years, is appointed as
public officer.
(b) The first public officer shall be the person who completed the application for incorporation
of the club.
(c) The committee may at any time remove the public officer and appoint a new public
officer provided the person appointed is 18 years of age or older and resident of New
South Wales.
(d) The public officer shall be deemed to have vacated his/her Position in the following
circumstances:
(i) Death.
(ii) Resignation.
(iii) Removal by the committee or a general meeting.
(iv) Bankruptcy or financial insolvency.
(v) Mental illness.
(vi) Residency outside New South Wales.
(e) When a vacancy occurs in the position of public officer, the committee shall within
fourteen (14) days notify the Department of Fair Trading by the prescribed form and
appoint a new public officer.
(f) The public officer is required to notify the Department of Fair Trading { Corporate Affairs Commission } by the prescribed form in the following circumstances:
(i) appointment (within 14 days)
(ii) change of residential address (within l4 days)
(iii) change in the club's objects or rules (within 1 month)
(iv) change in the membership of the committee (within 14 days)
(v) statement of the club's financial affairs (within 1 month after the Annual General
Meeting)
(vi) change in the club's name (within 1 month)
(g) The public officer may be an office bearer, committee member or any other person
regarded as suitable for the position by the committee.
(h) The public officer shall keep an up-to-date register of the club's members as stated
in Clause 4.
16) VISITORS
Any member may bring such visitors as he/she desires to any meeting. He/she, after the opening of the meeting shall introduce such visitors to the meeting.
17) HISTORIC VEHICLE CONCESSIONAL REGISTRATION
PART 1 - ELIGIBILITY FOR HISTORIC VEHICLES
a) All vehicles shall be a minimum of 30 years old; the onus of proof of age
shall be with the applicant. However, the final arbitrator shall be the Club
Committee.
b) Vehicles must be as close to original condition as possible, with no
alterations except for safety features. Period modifications will be
acceptable provided the owner can prove that such modifications were
options from the factory or available in the period.
c) All new members shall receive a copy of the Constitution and Rules for
Concessional Registration. Applicants shall read these rules and sign the
club indemnity form indicating that they fully understand their
responsibilities, and agree to abide with this Constitution before
endorsement of RTA paperwork for concessional registration.
d) Concessional Registration to be issued only to members that reside within a
120 kilometre radius of Yass. If members move beyond this distance the
plates must be returned to the RTA.
PART 2 - CLUB EVENTS
a) Historic vehicles shall only be used for Club events, except as set out in
Part 3 - Servicing of historic vehicles
b) Club events shall be:
• Events as set out on the YAMC club events calendar.
• Events conducted by Council of Motor Clubs Inc., Council of Heritage Motor Clubs Inc.
(the “Bush Council” ) or other Car Clubs to which an official written invitation has been
received by the club.
• Events conducted by a secondary club to which the member belongs. Permission shall
be obtained from the Registration Officer before attending such events. This shall be
entered in to the Registration Officer’s day book. Such events, organised by other clubs,
shall not count towards the three YAMC events per year requirements.
PART 3 - SERVICING OF HISTORIC VEHICLES
a) For town residents, a short road test of 5 km or less is permitted at any time after servicing
or repairs.
b) Any runs longer than a 5 km radius from place of registration necessary for the servicing or
road testing of historic vehicles, shall only be made after receiving permission from Plates
Registrar or, in his absence, from the President, Secretary or Treasurer. This permission
shall be properly recorded in the Day Book by the person approving the movement with full details of time, place and purpose of trip.
c) Members residing in country areas may use up to an 10 km radius from place of
registration. Exceptions may be made upon written application to the committee setting out
reasons for such exemption for those residing in country areas.
PART 4 - RESPONSIBILITY OF CLUB MEMBERS
a) All enquires regarding Concessional Registration shall be directed to the Registration Officer of the club.
b) Historic number plates are issued to a member of the club and are not transferable either
to another vehicle or person in the event of the vehicle being sold.
c) Historic number plates shall be immediately returned to the Roads & Traffic Authority:
• In the event of the sale of the historic vehicle on which they are issued.
• Upon the member's resignation from the Club.
• Upon the member's failure to remain a financial member within the meaning of the
Constitution of the Club or on failure to pay any levy that may be constitutionally approved
by a duly constituted Club meeting.
• If the Club committee considers the vehicle has been made unsafe or altered after it has
been inspected and deemed to be not in the spirit of the historic concessional registration
scheme.
• Any unauthorised use may revoke the right for access to the concessional registration
scheme.
d) Historic Concessional Registration is granted in the belief that the members' prime intent is
to use the historic vehicle for Club Outings. The Committee retains the right to reconsider
eligibility for issue or renewal should the vehicle not attend three (3) Yass Antique Motor
Club outings during the year without good cause.
e) Vehicles to be driven at all times to comply with R.T.A., Police and Enforcement Officers
direction. Members will abide by the Yass Antique Motor Club Inc. constitution and rules
including those guidelines set down for the use of vehicles on the Historic Vehicle
Concessional Registration Scheme.
PART 5 - ANNUAL HISTORIC VEHICLE INSPECTION
a) All historic vehicles shall undergo an annual inspection. By either obtaining a ‘pink slip’
from an RTA Authorised Inspection Station or by presenting the vehicle at a YAMC
Registration Day.
b) A member whose vehicle receives a Fail at the first inspection may present his/her vehicle
at a second inspection day to be held within one (1) month of the former day at a time and
place determined by the Registration Committee.
c) Such inspectors will be suitably qualified and will complete appropriate documentation.
d) Club Inspectors may not sign a road worthiness club certificate issued to himself/herself.
e) Moneys payable for renewal of club membership shall be paid before the annual historic
vehicle registration date.
f) Chassis, serial, body and engine numbers will form part of the identification of a Historic
vehicle. Any change shall be notified by obtaining a change of details certificate from an
authorised R.T.A inspection station, then notifying the Roads and Traffic Authority and the Club's Registration Officer.
PART 6 - INSURANCE REQUIREMENTS
A minimum insurance cover of Third Party Property Insurance is required
for all vehicles on Concessional registration. Proof of cover must be
provided to the Registration Officer. It is strongly recommended that full
comprehensive insurance be obtained.
18) MISCELLANEOUS
(a) The club shall effect and maintain insurance as is required under the Associations Incorporation Act together with any other insurance which may be required by law or regarded as necessary by the club.
(b) The funds of the club shall be derived from fees of members, donations, grants and such other sources as approved by the club.
(c) The Common Seal of the club shall be kept in the custody of the Secretary and shall only be affixed to a document with the approval of the committee. The stamping of the Common Seal shall be witnessed by the signatures of two (2) members of the Committee.
(d) The club may at any time pass a special resolution determining how surplus property is to
be distributed in the event that the club should be wound up. The distribution of surplus
property shall be in accordance with Section 53 of the Associations Incorporation Act 1984.
(e) Service of documents on the club is effected by serving them on the Public Officer or by
serving them personally on two (2) members of the Committee.
(f) The financial year of the club shall be from 1st January to 31st December and the Annual
General Meeting shall be held in March each year.
